कम्प्यूटर अपराध र नेपालको परिवेश

नेपालमा विद्युतिय अपराधसम्वन्धि कानुनको स्थापना ः

नेपाली बजारमा विभिन्न ठूला ठूला अन्तराष्ट्रिय कम्पनीहरुले विद्युतिय कारोवार निकै अगाडिदेखि गर्दै आएका छन् । उनिहरुले नेपालमा साइवर कानुनको स्थापना विना नै आफ्नो कार्यहरु अगाडी बढाइरहेको बेला नेपाल सरकार अन्तराष्टिय मान्यताअनुरुप अगाडी बढ्नको निम्ति आफ्नो पनि साइवर कानुन बनाउनुपर्ने बाध्यतामा पुग्यो र साइवर अपराधलाई कानुनको अधिनमा ल्याउनको लागि निर्मित एउटा समितिले फेवु्रअरी ४, २००४ मा संसद सामु आफ्नो प्रतिवेदन प्रस्तुत गर्यो र संसदीय प्रक्रियामा विभिन्न झण्झट बेहोर्दै सन् २००६ मा एउटा साइवर कानुनको स्थापना भएर कार्यान्वयन प्रक्रियामा अगाडी बढ्यो । त्यस कानुनको मुख्य उद्देश्य भनेको विद्युतिय कारोबारलाई व्यवस्थापन गर्नु र विद्युतिय हस्ताक्षर लगायत अन्य कारोवारहरुलाई अनुगमन गर्दै व्यक्तिगत तथा सार्वजनिक कारोवारहरुको संरक्षण र सम्बद्धन गर्नु तथा साइवर अपराधको अनुगमन गर्दै अपराधीलाई दण्ड दिनु रहेको छ । उक्त कानुनमा १२ धारा र ७९ उपधारा रहेका छन् । साइवर अपराधलाई अन्त्य गर्नको लागि प्रत्येक जिल्लाअदालतमा साइवर अपराध हेर्ने व्यवस्था मिलाइएको छ ।

साइवर अपराध के हो ?

विभिन्न अवान्छित कार्यहरु जस्तै सोर्सकोडको चोरी, विद्युतिय सामाग्रीको अबैधानिक प्रयोग, कम्प्यूटर र कम्प्यूटर सिस्टममा आक्रमण, अबैधानिक प्रकाशन, गोप्यता भंग, गलत सुचनाको प्रवाह आदि गर्नुलाई साइवर अपराध भनिन्छ । 

जव साइवर अपराध सम्बन्धि कानूनको निर्माण भयो, त्यसपछि विद्युतिय कारोवार गर्ने विभिन्न कम्पनीहरु आफ्नो कारोवारप्रति ढुक्क हुने अवस्था सिर्जना भएको छ । विशेष गरेर सूचना प्रविधिको निकै ठूलो फड्को मारेको नेपालको बैंकिङ्ग क्षेत्रलाई यसबाट ठूलो लाभ पुगेको छ किनकी बैंकहरुले प्रदान गर्ने विभिन्न सुविधाहरु एस्.एम्.एस्. बैंकिङ्ग, ए.टी.एम्., क्रेडिट कार्ड सुविधा तथा इन्टरनेट बैंकिङ्ग जस्ता सुविधाहरुप्रति सर्वसाधारण पनि ढुक्क हुने अवस्था आएको छ । 

साइवर अपराधको प्रवृत्ति

नेपालको साइवर अपराध विभागमा प्राप्त रीपोर्ट अनुसार विभिन्न कम्पनीहरुमा आउने गरेका हटमेल, याहुमेल, जीमेलहरुका स्पाम म्यासेजहरु जसमा पैसाको माग रहेको हुन्छ, पत्रिकाका वेवसाइटहरुको ह्याकिङ, वास्तविक सूचनाको परीवर्तन, नग्न केटीहरुको फोटो र पोर्न साइटका लिङ्क तथा व्यक्तिगत गोप्यताको भंग आदि साइवर अपराधका प्रकृतिहरु हुन् जुन तपाइ हाम्रो इमेलमा पनि वारम्वार आइरहन्छ । 

साइवर अपराध हेर्ने आधिकारीक निकाय

नेपालमा साइवर अपराध हेर्ने आधिकारीक विभाग नेपाल प्रहरी रहेको छ र यस सम्वन्धि सम्पूर्ण अनुसन्धान नेपाल प्रहरीले गर्नेछ र आवश्यकता अनुसार अदालतको कठघरामा समेत उभ्याउन सक्नेछ । जसकालागि साइवर कानुन अनुसार कुनै पनि व्यक्ति वा संस्थाले साइवर अपराध गरेका थाहा पाएमा ३५ दिन भित्र प्रहरीमा खवर गर्नुपर्ने हुन्छ । 

साइवर अपराधको दण्ड सजाँय

नेपालको साइवर कानुन अनुसार कुनैपनि व्यक्ति वा संस्थाले साइवर अपराध गरेका प्रमाणित भएमा अपराधको प्रवृत्ति हेरी ५०,००० देखि ३,००,००० सम्म जरीवाना र ६ महिना देखि ५ वर्ष सम्मको कैदको व्यवस्था रहेको छ । 

साइवर अपराधको अन्त्यका लागि नेपाल सरकारको अग्रसरता 

राष्ट्रिय रुपमा इन्टरनेटको अत्यधिक बढ्दो प्रयोगसँगै साइवर अपराधको पनि विभिन्न घटनाहरु बढिरहेको छ जसमा देश भित्र तथा देश वाहिरबाट हुने विभिन्न आक्रमणहरुले साइवर कानुनलाई समेत चुनौति थपेको छ । यस्ता किसिमका अपराधका लागि नेपाल सरकारले एक्लै कार्य गर्न नसक्ने हुनाले अन्तराष्ट्रिय स्तरमै अपराधको विरुद्ध विभिन्न सन्धि तथा सम्झौताहरुमा हस्ताक्षर गरेर नेपाल सरकारले पनि साइवर अपराधको निकारणका लागि अग्रसरता देखाएको छ । 

साइवर अपराधले थपेका चुनौतीहरु

साइवर अपराध विशेष गरेर इन्टरनेटबाट हुनेगर्छ र इन्टरनेटको नियन्त्रण संभव नभएकाले यसले साइवर अपराधको निराकरणका लागि खुलेका संस्थाहरुलाई ठूलो चुनौति दिएको छ । यति मात्र नभएर त्यस्ता संस्थामा दक्ष जनशक्तिको अभावमा साइवर अपराध विकराल रुप लिदै मौलाएको छ । विशेष गरेर साइवर अपराध निकै दक्ष र प्राविधिक व्यक्तिबाट गरीने हुनाले कसरी अपराध भयो भन्ने द्धिविधा र यसको निराकरणको कुनै निर्दिष्ट उपाय नहुने हुनाले यसको अन्त्य गर्न चुनौती थपिएको छ ।

साइवर अपराधको अन्त्यका लागि नेपाल प्रहरीको अग्रसरता ः

नेपाल प्रहरी साइवर अपराधको अनुसन्धान गर्ने र कारवाहीको लागि सिफारीस गर्ने आधिकारीक संस्था भएको हुनाले यसले साइवर अपराधको अन्त्यका लागि विभिन्न कार्यको थालनी गरेको छ जस  अन्तर्गत मोवाइल फोन, तारविहिन प्रविधि र प्रोक्सी ठेगानाको अनुगमन, मातहतका प्रहरीलाई साइवर अपराध सम्वन्धि विशेष तालिमको व्यवस्था, सामाजिक सचेतनाका कार्यक्रमहरु, अन्तराष्ट्रिय अपराधको सम्वन्धित निकायमा तुरुन्त सूचना प्रवाह र छिमेकी देशहरुसँगको सहकार्य गर्दै आएको छ । 

सामान्यतया साइवर अपराधका घटनाहरुमा व्लाकमेलीङ, इमेलमा आउने धम्की, कम्प्यूटरको सूचना चोरी, पाइरेसी, ह्याकिङ, समाजमा असर गर्नेगरी इन्टरनेटको प्रयोग, व्यक्तिगत सूचनाको भंगता, ए.टी.एम्.बाट पैसा चोरी, इन्टरनेटबाट गरीने प्रोमो, कम्प्यूटर भाइरसको निर्माण, सरकारी वेवसाइटको सूचना चोरी, जस्ता घटनाहरु नेपालमा देखिने साइवर क्राइमका उदाहरण हुन् । 

निष्कर्ष

हामी वास्तवमा इतिहासका त्यस्ता रोचक पानाहरुमा आफ्नो कार्य गरीरहेका छौँ त्यो वास्तवमै निकै उत्साहजनक रहेको छ र इन्टरनेटको प्रयोगले हामीलाई संसारलाई नै सानो कोठामा बसेर हेर्न मिल्ने बनाइदिएको छ, जहाँ हामी विभिन्न किसिमका शैक्षिक सामाग्रीहरुको प्रयोगले व्यक्तिगत दक्षता र क्षमतालाई सुदृढ गर्न विशेष सहयोग गर्दछ । विशेष गरेर इन्टरनेटको प्रयोग कुनैपनि सकारात्मक कार्यका लागि प्रयोग गरीने भएपनि केही व्यक्तिहरुले यसको प्रयोग गरेर विभिन्न किसिमका अपराधिक कार्यहरु गरीरहेका छन् । 

यसको निराकरणका लागि हामीले आफूले पनि विभिन्न किसिमका अपराध सम्वन्धि सामाग्रीहरुको अध्ययन गर्ने र अरुलाई पनि यस सम्वन्धि बुझाउने तथा कतै अपराधीक कार्य भएको पाइएमा सम्वन्धित निकायलाई खवर गर्नुपर्छ र हामीले आफूलाई सभ्य नागरिकको उदाहरण दिनुपर्दछ । 

वास्तवमा सच्चा प्रेम के हो ?

प्रत्येक वर्षमा मनाइने प्रेम दिवससँगै प्रेमका अद्भुद र नयाँ रुपहरु हामीले देख्न पाइन्छ । आजभोली बजारमा प्रेमको अनेकौँ प्रकारहरु देख्न पाइन्छ । वास्तवमा हामीले प्रेम शव्दलाई बुझ्न जान्नुपर्छ । हामीले मन भित्रको मायालाई बुझ्न सक्नुपर्छ । प्रेम शव्दको गहीराइ यदि गहन छ जुन अहिलेको युवा पुस्ताले बुझेको भन्दा निकै फरक छ । प्रेम मानवको स्वभाव हो, यो जिवनको एउटा उच्चतम अवस्था हो, मगमग सुवास छरेर फुलेको फूल जुन अवस्थामा छ त्यो प्रेमको अवस्था हो । बलेको दियो जुन अवस्थामा हुन्छ, त्यो प्रेमको अवस्था हो । जसरी सूर्यले सवैलाई बरावरी किरण छरीरहेको अवस्था हो, त्यो प्रेमको अवस्था हो । जुन दिन व्यक्ति प्रेमको स्थितिमा पुग्छ, त्यो दिन उसले २४ सै घण्टा प्रेम दिवस वा प्रेम उत्सव मनाइराखेको हुन्छ । विशुद्ध प्रेम गर्नेहरु सँधै खुसी हुन्छन्, निडर हुन्छन् अनि उनिहरुको मायामा आत्मविश्वास हुन्छ । तर यहाँ सत्य प्रेमको निकै ठूलो अभाव छ, यहाँ स्वार्थ विनाको मायाको हाहाकार छ । वास्तवमा मायामा लिन हैन दिन जान्नुपर्छ र यहाँ पाउँदा घाँडो मान्ने र नपाउदा दुःखी हुनेको निकै ठूलो हिस्सा रहेको छ ।

प्रेम एउटा आकर्षण मात्र होइन, शरीरले शरीको माग गर्दछ, जसलाई हामी कामवासना भन्छौँ, त्यही काम वासनालाई प्रेम ठानेको अवस्था हो अहिले युवाहरुले । मनले मनको माग गर्दछ, जसलाई हामी माया भन्छौँ, त्यही मायालाई हामीले प्रेम ठानीरहेको स्थिति हो अहिले । तर जव आत्मले आत्माको माग गर्दछ भने त्यही नै सच्चा प्रेमको अवस्था हो । प्रेम एउटा सकारात्मक उर्जाको प्रवाह हो । कसैलाई देख्दा जव आकर्षण आउँछ तर अर्कालाई देख्ना प्रेमानुभूती हुँदैन भने त्यो सच्चा प्रेम होइन । जो सुकै होस्, सवैप्रति एउटा सकारात्मक आकर्षणता पैदा भएको स्थिति प्रेमको स्थिति हो । प्रेम वावुआमा र छोराछोरी विच पनि हुनसक्छ, दाजुभाइ र दिदीवहिनीमा पनि अथाह माया हुन सक्छ । तर यो भन्दा विल्कुलै फरक छ अर्को माया जहाँ युवापुस्ताहरु निकै दौडिरहेका छन् । कति सफल छन्, कति विरक्तिएका छन् ।

प्रेम त हीरा हो, तर प्रेम हीरा हो भनेर कोइलालाई उपेक्षा गर्न मिल्दैन किनकी कोइलाबाट नै हीरा हुने हो । यदी तपाइसँग कामवासना छैन भने त्यो विनाको प्रेमको पनि कुनै अर्थ रहदैन । वास्तवमा आज प्रेम गर्ने तथाकथित प्रेमी प्रेमीकाहरु पनि आफ्नो प्रेममा सन्तुष्ट रहेको पाइदैन । उनीहरु भन्दा दुःखी सायद अरु कोही नहोलान् । वास्तवमा प्रेमले त आनन्द दिनुपथ्र्यो, प्रेमले त मस्ति दिनुपथ्र्यो, ढुक्क हुने अवस्था सिर्जना हुनुपथ्र्यो, विस्वास दिनुपथ्र्यो व्याकुलता होइन्, तर अहिले हरेक जोडीहरु व्याकुल छन्, जति प्रेमी प्रेमीका बनाएपनि युवाहरु तृप्त छैनन् । यसमा काम, क्रोध, लोभ, मोह तथा अहंकारले ठूलो भूमिका खेलेको हुन्छ । यदि कुनैपनि निस्वार्थ भावले प्रेम गर्ने हो भने अवश्य तृप्ती मिल्छ । जव प्रेमी प्रेमीकाले एक अर्कालाई प्रेमामुर्ति मानेर पुजा गर्ने हो भने , सच्चा र निस्वार्थ भावले माया गर्ने हो भनेमात्र उनिहरुको जोडीलाई निश्चल प्रेमाआकाशमा प्रेमपुञ्ज बनेर उडाउँछ । तर आज यहाँ दुःखी बनेका छन् मानिसहरु, वास्तविकता लाई नबुझिकन उनीहरुले सोचे जस्तो कहाँ हुन्छ र जीवन ? अनि खोजेर कहाँ पाइन्छ र प्रेमी वा प्रेमीका ? यो त आफ्सेआफ उत्पत्ति हुने कुरा हो । आखिर हामीले जे भोगिन्छ, जे गरीन्छ, त्यो नै जीवन हो र त्यसैमा अडिएको हुन्छ माया । त्यसैले यदि कसैलाई माया गर्नुछ भने सकारात्मक सोच हुनैपर्छ । अनि त्यो प्रेम सफल हुन्छ जुन प्रेमले केही चाहेकै हुँदैन मात्र निरन्तर माया गरेको हुन्छ चाहे मायालु वस्तु आफ्नो वसमा होस् वा नहोस् ।   प्रेमलाई सफल बनाउने हो भने एकले अर्कालाई आधिपत्य जमाउनु हुँदैन । प्रेमी वा प्रेमीकाले आफ्नो प्रेमीलाई सम्पत्ति ठान्नु हुँदैन । एक अर्काको प्रति कदापी जासुसी गर्नुहुँदैन । तँ त मेरो हो, तैले अरुसँग हेर्नुपनि हुँदैन, बोल्नुपनी हुँदैन, मैले जे भन्यो त्यही मान्नुपर्छ भन्ने जस्ता कुराहरु कदापी गर्नुहुँदैन । प्रेमी र प्रेमीका त मन्दिरको खम्वा जस्तो हुनुपर्छ, जुन धेरै नजिक पनि हुनुहुदैन र धेरै टाढा पनि हुनुहुँदैन किनकी खम्वाहरु धेरै नजिक वा धेरै टाढा जाँदाखेरी छाना भत्कन्छ, त्यसरी नै प्रेमी र प्रेमीका धेरै नजिक हुँदा पनि आकर्षण घट्छ र धेरै टाढा हुँदाखेरी पनि जति हुनुपर्ने हो त्यो आकर्षण कायम नरहन सक्छ । त्यसैले प्रेमलाई कायम राख्ने हो भने निस्वार्थ तँ दे वा न दे म दिन चाहन्छु भन्ने भावना हुनुपर्छ । यहाँ त आफूले दिनु कहाँ छ कहाँ उस्ले मलाई प्रेम गरेन, त्यो दोषी भनेर आरोप लगाउने चलान छ । यस्ता कुरालाई निराकरण गर्यो भने अवश्य नै घर मन्दिर हुन्छ  र प्रेमी र प्रेमीका मन्दिरका देवी देवता हुन्छन् ।
वास्तवमा हामीले बुझेको शारीरिक र मानसिक आकर्षण त प्रेम हैन । आत्मिक स्थिती नै प्रेम हो र हामीले शारिरीक आकर्षणलाई आत्मिकता तिर मोड्न सकेमा हामी अमर प्रेमको उकाली चढ्न थाल्नेछौँ जहाँ हामीलाई आध्यात्मिक ज्ञानको पनि आवश्यकता पर्न जान्छ । पहिले प्रेम के हो भनेर बुझ्नुपर्छ अनि मात्र प्रेमको कार्यान्वयन गर्नुपर्छ किनकी प्रत्येक मानवको मुटुको धड्कनमा माया धड्केको हुन्छ । यसको अर्थ नवुझेर नै कतिलाई मायाले रुवाएको छ, कतिलाई तड्पाएको छ । त्यसैले हरेकका मनमा सँधैका लागि मायाको व्यवहार हुनुपर्छ अनि हामी मायामा दुःखी होइन सुखी बन्नुपर्छ ।

Microsoft revealed the finer details of its Windows 8 ARM edition today, but the company also unveiled the look and feel of its next-generation Office experience. The software giant casually demonstrated beta copies of Word, Excel, PowerPoint, and OneNote during a preview video of its Windows 8 ARM work. Office 15 includes a flatter look and feel, based on the company's Metro design language. The applications are desktop ones, not the new Metro style that Microsoft is creating for Windows 8.

In the screenshots below, you can see how Microsoft has included more white space, and uses fewer lines in an effort to focus on content. The ribbon menu appears to be removed or hidden in the demonstration, hinting that Microsoft may be moving away from this user experience for Office 15. The company didn't reveal any additional details today but it's clear that Office 15 is visually different from its predecessor, Office 2010.

Facebook is now letting all developers make apps that can automatically publish to profiles

Sixty applications that let users publish information automatically to Facebook launched at a news conference held at a trendy nightclub here on Wednesday. Many of these are new versions of existing online services or mobile apps.
Apps for foodies, like Foodspotting and Foodily, can publish to a user's Facebook profile when she updates her digital diary of meals. Ticketmaster can publish to Facebook when customers buy concert tickets.
Like with Facebook Music, the social network may create monthly personalized reports that are posted to a person's profile showing how the app was used at any given time. For example, someone could see the places a friend traveled to last summer, thanks to TripAdvisor.
Since the launch of Facebook Music in September, participants such as MOG and Spotify have reported large increases in membership. Some 400,000 people coming from Facebook have signed up for MOG accounts since September, and each day, Facebook sends an average of 4,000 people who have never visited MOG before, David Hyman, the music company's CEO, said in a phone interview.

"The platform itself is the biggest traffic generator we've ever had," Hyman said. "It is very significant."
Facebook programmers have created a mathematical algorithm that will examine the types of posts a person has chosen to give prominent placement to on his or her profile, Facebook CTO Bret Taylor said in an interview.
Whether food, movies or exercises logged into Facebook, the site will try to predict what you're most passionate about based on past choices, similar to how the system determines its news feed based partly on the people you contact most often, Taylor said. Each user will be able to manually override these profile placements, he said.
"People care a lot about the way their profile looks," Taylor said.
These features are only available to those who have enabled the Facebook Timeline, which opened to everyone about a month ago. Eventually, every user will be required to use that version of the site profile.
Taylor described the new app features as part of a maturation of Facebook, which goes beyond the initial perspective of its co-founder, Mark Zuckerberg, who coded the website in his sophomore year at Harvard University. Zuckerberg, who is now Facebook's CEO, did not attend the event Wednesday.
"Previously, the profile was all the things Mark Zuckerberg was interested in in college," Taylor said. "You know, movies, music and books."
(Zuckerberg, 27, only lists one book on his Facebook profile: Ender's Game, which came out the year after he was born.)
Facebook will review each new action, as it's called, that's proposed by developers in order to screen for profanity or other unwanted words, Mike Vernal, the company's platform engineering director, said in an interview. Software developers will be able to create an unlimited number of these actions, he said.
That would be useful for something like iTunes, which allows users to "listen," "watch" and "buy" things, although Apple is not participating in the program. A spokesman didn't respond to a request for comment.
Despite some early opposition, Facebook wants to encourage all developers to adopt the new tools.
"We've got a whole new set, a whole new class, of applications that we think we're enabling with this platform," Carl Sjogreen, a Facebook product director, said onstage during the announcement. "When we say anything, we really mean anything."
In characteristic Facebook ambition, Sjogreen added, "We're even more excited about the thousands of apps to come."
